Forte Terms

These terms and conditions create a contract between you and MobileEducation, LLC (the "Agreement"). By using our services (known collectively as the "Services"), you agree to be bound by these terms.
Using our services
This Agreement governs your use of our Services, through which you can access our content (the "Content"). To use our Services, you need compatible hardware, software (latest version recommended and sometimes required) and Internet access (fees may apply). Our Services' performance may be affected by these factors and we are not responsible for any degradation of performance or experience of our Services.
You can acquire Content on our Services for free or for a charge. When you acquire Content on our Services, you do not own the Content, nor can you sell, transfer, or otherwise redistribute the Content.
Privacy
Your use of our Services is subject to our Privacy Policy which is available at https://joinforte.com/privacy.html.
Content Usage Rules
You may use the Services and Content only for personal, noncommercial purposes, unless your Paid Subscription specifically allows for such use. Our Services and Content are licensed, not sold, to you. The delivery of Content does not transfer any commercial or promotional rights to you, and does not constitute a grant or waiver of any rights of the copyright owners. The licenses that govern your use of the open source software included in our Services can found at https://joinforte.com/acknowledgements.html.
You must be at least 13 years old to register an account within our Services. If you are younger, your legal guardian may register an account for you, using their personal information, to use and have access to our Services and Content.
When accessing our Content through our iOS App (the "iOS App"), your use of the iOS App is governed by Apple's Standard End User License Agreement which can be found at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
You may not tamper with or circumvent any security technology included with the Services or used to protect the Services from unauthorized use. You may access our Content only using our Services, and may not modify or use modified versions of such software.
We may receive anonymous technical data and related information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to our Services and Content. We may use this information, as long as it is in a form that does not personally identify you, to improve our Services.
We may at any time, for any reason, at our sole discretion, terminate your account and access to our Services and Content.
Subscription Terms
Our Services allow you to purchase access to Content on a subscription basis (the "Paid Subscription"). The Paid Subscription automatically renews unless cancelled at least 24 hour prior to the renewal date. Your Paid Subscription is handled by one of two merchants/marketplaces (known collectively as the "Marketplaces"):
- When purchased through the iOS App, your Paid Subscription is managed by Apple. Your subscription through Apple is governed by Apple's Media Services Terms and Conditions which can be found at https://www.apple.com/legal/internet-services/itunes/us/terms.html.
- When purchased through our Web App, your Paid Subscription is handled by PayPal. Your subscription through PayPal is governed by the section below entitled "PayPal Subscriptions" and the PayPal User Agreement which can be found at https://www.paypal.com/us/webapps/mpp/ua/useragreement-full?locale.x=en_US.
If you no longer wish to subscribe to the Paid Subscription, you must cancel through the appropriate Marketplace at least 24 hours prior to the renew date listen in your account settings page.
If technical problems prevent or unreasonable delay delivery of the Content, it is your sole responsibility to contact either the appropriate Marketplace or us directly to resolve the issue.
Refunds for subscriptions made through Apple are subject to Apple's terms. Refunds for subscription made through PayPal are subject to the terms below entitled "PayPal Subscriptions". We may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior that entitles MobileEducation, LLC to an appropriate corresponding counterclaim.
PayPal Subscriptions
Paid Subscriptions purchased through PayPal are governed by the following terms:
The Paid Subscription purchased through PayPal (known collectively as the "PayPal Subscription") is tuition for access to certain Content available exclusively through our Services. Sales tax will be calculated prior to your purchase of the Paid Subscription and be included in the price of the Paid Subscription and will differ depending on your location at the time of initial purchase. We may collect sales tax even if you are exempt from the collection of sales tax in your location at time of purchase. Sales tax will be collected even if you reside in a country outside of the United States. The sales tax applied to your Paid Subscription will remain constant throughout the lifetime of your Paid Subscription regardless of any change in location.
NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES PERFORMED OR PROVIDED BY THE SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SERVICES AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.
